Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the Taptugo website and services (the “Service”). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.
Taptugo is an online business directory that allows registered users to submit, manage, and display business listings. Taptugo also operates an NFC-based customer rating system through which customers may submit ratings of listed businesses.
2. Definitions
- “User” means any individual who creates an account on the Service.
- “Listing” means any business information submitted to the directory by a User.
- “Content” means all text, images, data, and other materials submitted, posted, or displayed through the Service.
- “Rating” means any score or review submitted by a customer via an NFC tap interaction associated with a Listing.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials secure and confidential.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.
4. Business Listings
4.1 Submission
Users may submit business listings to the directory. By submitting a Listing, you represent and warrant that:
- The information provided is accurate, truthful, and not misleading.
- You have the right and authority to submit the Listing.
- The Listing does not infringe any third-party rights, including intellectual property rights.
4.2 Licence
By submitting a Listing, you grant Taptugo a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute the Listing content for the purpose of operating and promoting the directory. This licence ends when you remove the Listing or delete your account, subject to any reasonable period needed for technical removal.
4.3 Moderation
We reserve the right to review, edit, or remove any Listing at our discretion, including Listings that we believe violate these Terms, our Acceptable Use Policy, or applicable law. We are not obligated to publish any Listing.
5. NFC Ratings
5.1 Integrity
Ratings submitted through the Taptugo NFC system must reflect genuine customer experiences. The submission of false, manipulated, or artificially generated ratings is strictly prohibited. This includes, but is not limited to:
- Tapping an NFC chip multiple times in rapid succession to inflate a rating score.
- Encouraging, incentivising, or directing individuals to submit ratings that do not reflect a genuine experience.
- Using any automated or mechanical means to generate tap events or rating submissions.
- Coordinating groups of people to submit identical or bulk ratings within a short period.
5.2 Monitoring
Taptugo monitors rating activity on the platform and uses automated systems to detect unusual tap patterns and rating anomalies. Business owners are responsible for the rating activity associated with their NFC chips, regardless of whether the activity was carried out by the owner or a third party acting on their behalf.
5.3 Disputed Ratings
Where Taptugo reasonably suspects that ratings associated with a Listing have been manipulated, we reserve the right to:
- Exclude suspected ratings from a Listing’s public score without prior notice.
- Contact the business owner to discuss the activity.
- Suspend the Listing pending review.
- Permanently remove manipulated ratings from the platform.
Decisions regarding rating integrity are at Taptugo’s sole discretion. Excluded or removed ratings are not reinstated except where Taptugo determines in its sole judgment that the activity was legitimate.
5.4 Consequences
Repeated or serious violations of this section may result in suspension or permanent removal of the Listing and associated account, without refund of any fees paid.
6. Payments
Where the Service involves paid features or listings, payments are processed by Stripe. By making a payment, you agree to Stripe’s terms of service. All fees are stated in pounds sterling (GBP) and are inclusive of VAT where required by law.
Refunds may be provided at our discretion, and any applicable refund policy will be communicated at the point of purchase. You are responsible for ensuring that your payment details are current and accurate.
7. Intellectual Property
All intellectual property rights in the Service (including the website design, code, logos, and branding) are owned by or licensed to Taptugo. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.
You retain ownership of the Content you submit to the Service, subject to the licence granted in Section 4.2.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Submit false, misleading, or fraudulent information.
- Manipulate the rating system in breach of Section 5.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorised access to any part of the Service.
- Use automated means (bots, scrapers, etc.) to access or collect data from the Service without our prior written consent.
- Upload or transmit viruses, malware, or any other harmful code.

9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not guarantee the accuracy, completeness, or reliability of any Listing or Content on the Service.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total aggregate liability to you for any claims arising from or relating to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Taptugo, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your Content, or your breach of these Terms.
11. Termination
You may terminate your account at any time by contacting us or using the account deletion feature (if available). We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall continue in effect.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will notify users of material changes by email or through the platform.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
